Right of withdrawal, complaints and warranty
Under Articles. 64 et seq of Legislative Decree no. 206/05, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does the purchase by indicating in a reference order form of VAT), he is entitled to terminate the purchase contract for any reason, without explanation and without penalty.
The withdrawal must be expressed by sending within 10 days, a registered letter with acknowledgment of receipt to the following address: IRBA Srl via Catone, 15 – 00192 Roma (RM). The consumer may not exercise this right of withdrawal for the same products made to specifications or clearly personalized or which by their nature can not be returned or are liable to deteriorate or expire rapidly. Within the stipulated period of 10 days must be returned to the sender-supplier all goods purchased intact and in their original packaging and any manuals, without any lack. Return fees will be charged to the customer. Upon receipt of the request IRBA Srl will credit the entire amount paid by the consumer within thirty days of receipt of returned goods. It is the responsibility of the consumer promptly provide the bank on which to obtain the transfer (Cod. ABI, CAB, Current account, IBAN). All products for sale in our shop enjoy 6-month warranty.
The right of withdrawal is subject to the following conditions:
– The law applies to product purchased in its entirety; it can be exercised only on the withdrawal of the product purchased;
–The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and any accessories); to limit damage to the original package, we recommend to enter into a second box on which to affix the address of IRBA Srl; It should be avoided in all cases the attachment of labels or tape directly on the packaging of the product;
– The shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the Customer;
– If the goods are damaged during transport, IRBA Srl will inform the customer (within 5 working days of receipt of goods in their stores), to enable him to file a timely complaint against the carrier of his choice and to obtain reimbursement the value of the property (if insured); in this case the product will be made available to the customer for its return, while canceling the request for withdrawal;
–IRBA Srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
– on his arrival in stock, the product will be examined to assess any damages not caused by transport; if the package and / or the original packaging are damaged, IRBA Ltd will subtract from the refund due to a percentage, but no more than 10% of it, towards the cost of restoration.
The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), in cases where IRBA srl finds:
-not diligent use of the good that has compromised its integrity or the use of various supplies;
-the lack of the outer and / or the original inner packaging;
-the product is damaged for causes other than its transport;
In case of forfeiture of the right to withdraw the goods remain at the headquarters of IRBA srl available to the customer for pick against him ..
